‘징역 17년형 확정’ JMS 정명석, 여신도 성폭행 혐의로 수감 속 교도소 독방 특혜 의혹 #기독교복음선교회 #JMS #정명석 #나는신이다 #그것이알고싶다 기독교복음선교회(JMS) 정명석 총재가 여성 신도 성폭행 등의 혐의로 수감된 가운데 수감 기간 상당 부분을 독방에서 지내며 특혜를 누리고 있다는 의혹이 제기됐다. 이달 30일 연합뉴스 보도에 따르면 정 총재는 여신도 성폭행 혐의로 첫 번째 수감된 2008년부터 2018년까지 서울구치소와 군산교도소, 대전교도소를 옮겨 다니며 10년간 독거실을 사용한 것으로 알려졌다. 지난 2023년 4월 22일 방송된 SBS ‘그것이 알고 싶다’에는 기독교순복음교회(JMS) 정명석 총재가 출소 이후에도 멈추지 않았던 성 추문에 대한 취재기가 공개됐다. (사진=SBS ‘그것이 알고 싶다’ 당시 사회 저명인사로서 명예를 보호하기 위해 특별히 필요한 사람의 경우 독거실에 우선 수용할 수 있다는 계호업무지침에 따라 이뤄졌던 조치였다. 해당 지침은 정 총재 출소 이듬해인 2019년 폐지됐다. 대전교도소 독거실은 5.04㎡ 또는 5.12㎡ 규모다. 2인실은 6.72㎡, 3인실은 10.08㎡로, 독거실을 사용할 경우 2-3인실에 수용될 때보다 최소 1.5배 넓은 면적을 쓸 수 있었던 셈이다. 정 총재는 출소 이후에도 여신도를 상대로 성폭행을 저질러 2022년 다시 수감됐다. 징역 17년 확정판결을 받은 정 총재는 재수감 이후에도 상당 기간 독방에서 지낸 것으로 전해졌다. 2022년 10월 11일 대전교도소에 입소한 정 총재는 일주일 동안 코로나19 격리를 위해 독거실에 수용됐다가 19-24일 닷새간 신입 혼거실에서 지낸 것으로 알려졌다. 이후 10월 25일부터는 독방 생활을 한 것으로 전해졌다. 약 5개월간의 독거실 생활 후 정 총재는 2023년 3월 24일 고령 노인 혼거실로 옮겨져 다른 사람들과 생활하기 시작한 것으로 알려졌다. 그 해 3월은 넷플릭스 ‘나는 신이다 : 신이 배신한 사람들’이 공개된 시점이다. 독방 생활 중인 점이 반 JMS 활동가 김도형 단국대 교수에 의해 알려지자 혼거실로 옮긴 것으로 풀이된다. 2년 3개월 동안 혼거실에서 다른 이들과 함께 지냈던 정 총재는 지난해 7월 10일 의료과 요청에 따른 조치로 2인실인 치료거실로 옮겨진 것으로 전해졌다. 아울러 정 총재는 치료거실에서 함께 지내던 다른 수용자의 수용거실이 바뀐 뒤에는 다시 사실상 독방을 쓴 것으로 알려졌다. 또 정 총재는 지난해 12월 13일 다른 수용자가 방을 옮긴 후 최근까지 약 3개월 동안 2인실인 치료거실에서 홀로 지낸 것으로 전해졌다. 교정당국은 취재가 시작된 이달 20일부터 정 씨를 치료거실에서 다른 수용자와 함께 수용한 것으로 알려졌다. 넷플릭스 ‘나는 신이다 : 신이 배신한 사람들’에서 가해자로 지목된 JMS 총재 정명석은 지난 2018년 2월부터 2021년 9월까지 충남 금산 수련원에서 홍콩 및 호주 국적의 여신도들과 한국인 여신도를 총 23차례 성폭행하거나 추행한 혐의로 기소된 바 있다. 이에 정명석은 최근 재판에서 징역 17년형이 선고된 바 있다. 1945년생인 정명석은 올해 만 79세로 징역 17년형이 확정되면서 남은 생을 감옥에서 마감하게 될 전망이다.  지난해 1월 9일 대법원 2부는 준강간, 준유사강간 등으로 기소된 정명석의 상고심에서 원심을 확정했다. 정명석은 과거 여신도들을 성폭행한 혐의로 징역 10년을 선고받아 구속됐다가 2018년 2월 출소한 바 있다.  그러다 2023년 11월 검찰은 정명석에게 징역 30년을 구형했고 같은 해 12월 법원은 징역 23년을 선고했다. 이에 양측 모두 항소해 지난해 9월 검찰은 30년을 구형했지만, 같은 해 10월 2심 법원은 징역 17년을 선고했다.  해당 사건과 별개로 정명석은 JMS 수련원 약수터 물이 병을 고치는 효과가 있다며 ‘월명수’로 이름 지어 판매해 20억 원 상당을 벌어들인 혐의로도 재판에 넘겨졌다.

(사진=연합뉴스) 연합뉴스에 따르면 정명석은 2008년부터 2018년까지 약 10년간 서울구치소와 군산·대전교도소 등 여러 시설을 옮겨 다니는 동안 대부분 독거실에 수용됐다. 이는 당시 ‘사회 저명인사의 명예 보호’를 이유로 독방 배치를 허용한 내부 지침에 따른 조치였다. ○ 성폭행범에 ‘저명인사 보호’ 적용 논란 이 지침은 출소 다음 해 폐지됐지만, 적용 당시 기준 자체가 문제라는 지적이 이어지고 있다. 특히 연쇄 성폭행 범죄를 저지른 인물이 ‘보호 대상’으로 분류됐다는 점은 제도 취지와 정면으로 배치된다는 평가다. 정명석은 출소 이후 다시 범행을 저질러 2022년 징역 17년형이 확정됐고, 재수감 이후에도 독방 생활이 반복됐다. 입소 직후 코로나 격리를 거쳐 일반 혼거실에 머문 기간은 단 며칠에 불과했고, 이후 다시 독거 상태로 전환됐다. ○ 반복된 독방 수용…구조적 특혜 의혹 이후에도 그는 치료거실 등 2인실에 혼자 머무르는 사실상 ‘독방’ 상태를 이어갔다. 특히 다른 수용자가 이동한 이후 수개월간 단독 사용이 지속되면서 일반 수용자와의 형평성 문제가 불거졌다. 교정당국은 “수용 여건과 의료 판단에 따른 조치”라고 설명했지만, 외부 공개 시점과 맞물려 수용 형태가 바뀐 점은 의혹을 키웠다. 넷플릭스 다큐멘터리 방영으로 사건이 재조명된 이후 혼거실로 이동한 정황은 여론 대응 차원이라는 해석도 나온다. 김도형 단국대 교수는 사건 구조를 설명하며 “연쇄 성폭행범에게 ‘명예 보호’ 기준이 적용된 것 자체가 납득하기 어렵다”고 지적했다. 이어 그는 산업·제도적 영향 측면에서 “교정 시스템이 특정 인물에게 유리하게 작동한다면 형벌의 공정성 자체가 무너진다”고 강조했다. 또 김 교수는 정책 판단 관점에서 “건강 상태가 장기간 독방 치료가 필요할 수준이 아니라는 점이 확인된 만큼, 단순 행정 판단이 아닌 특혜 여부에 대한 수사까지 검토해야 한다”고 주장했다. ○ 교정 행정 신뢰 흔드는 구조적 문제 이번 사안은 단순 수용 형태를 넘어 교정 시스템 전반의 신뢰 문제로 확산되고 있다. 동일 범죄자 간 처우 격차가 발생할 경우 형벌의 억지력과 공정성 모두 훼손될 수 있다는 점에서 제도 재점검 필요성이 제기된다. 특히 사회적 파장이 큰 중대 범죄자일수록 엄격한 기준이 적용돼야 한다는 원칙과 달리, 오히려 편의가 제공된 정황은 국민 법 감정과 충돌하고 있다.

JMS 선교회에는 이달 17일 보도 자료를 통해 같은 달 15일과 16일 이틀간 충남 금산군에 위치한 월명동 자연성전에서 대규모 행사를 개최한 점을 알렸다.  지난 2023년 4월 22일 방송된 SBS ‘그것이 알고 싶다’에는 기독교순복음교회(JMS) 정명석 총재가 출소 이후에도 멈추지 않았던 성 추문에 대한 취재기가 공개됐다.
