Rivera Vazquez Condemns Trump's Attack on the 14th Amendment as Supreme Court Hears Birthright Citizenship Case
“No president has the power to rewrite the Constitution by executive order. This case is about whether we keep our promise to every child born on American soil.”
BEAUFORT, S.C. — As the United States Supreme Court heard oral arguments today in Trump v. Barbara, the most significant constitutional challenge to birthright citizenship in American history; Mayra Rivera Vazquez, Democratic candidate for South Carolina’s First Congressional District, issued the following statement condemning the Trump administration’s effort to strip citizenship from children born on U.S. soil.
“The 14th Amendment is not a loophole. It is a promise,” said Rivera Vazquez. “Written in the aftermath of the Civil War to ensure that no government, not a court, not a president, not a king, could ever again decide that some people born on American soil are less than citizens. That promise is on trial today.
“I am running for Congress in South Carolina’s First District. My community knows what it means to be told you don’t fully belong here. We know what it means to have your dignity questioned, your legitimacy challenged, your children’s future put on the line. That is exactly what this executive order does and it is exactly what the 14th Amendment was written to prevent.
Every federal court that has reviewed this order has found it unconstitutional. Legal scholars across the political spectrum have called it a rewriting of the Constitution itself. The plain text of the amendment is unambiguous: all persons born in the United States and subject to the jurisdiction thereof are citizens. There is nothing ambiguous about that. There is nothing to reinterpret.
If this administration succeeds, it will not just affect future children, it will cast a shadow over the citizenship of millions of Americans going back decades, creating the kind of permanent underclass this nation fought a Civil War to abolish.
I stand with the families whose children’s citizenship hangs in the balance today. I will carry this fight to Congress, where I will oppose any effort, legislative or otherwise, to undermine the 14th Amendment. The floor of our democracy is not negotiable.”
